Can a collection agency call after you have given them your bankruptcy attorney’s number?

Lemondrop asked:

I received a phone call from a collection agency about a month ago, Tibouron Financial to be exact. I told them very nicely that I had retained a bankruptcy attorney and gave them his name and number. They have called me twice today, and everytime they have called, I would answer the phone on the second ring and there would be a dial tone. Also I should add that this was 7:30 at night. What should I do?

I know of a person who fell on some very hard times and now has let 8 months go by without paying on his credit cards. It appears that now some of the cards have written off his loan as bad debt, or have turned the delinquent accounts over to collection agencies. This person is unfortunately still so pennyless (and so in debt- close to $80,000 between a handful of credit cards) and he still cannot afford the legal fees to file for bankruptcy. At this point, since he is so delinquent on his credit cards, and his credit is already turned bad after being delinquent for 8 months, is there any reason to file for bankruptcy? He has heard that the bad debt will drop off his credit record after about 7 years, just as one’s record of going bankrupt would. Can anyone validate that this is true? Could there be any advantages for him to go through the bankruptcy process at this point? In other words, what would be the difference in his credit ultimately?

Has anyone been through bankruptcy in Texas? How can I buy a car during/after?

If everything goes as planned, next month I will be filing chapter 7 bankruptcy. I have a free car to drive as long as it lasts, but I will need a newer car fairly soon. How can I get loan for a newer, more reliable car (not neccessarily a brand new car)?
That’s the thing – I DON’T have the money for a new car. My current car payment was about $500/ mth. I can’t afford this after rent, utilities, etc. so I am letting the car go back. My parents are letting me borrow an old car which is quick possibly on its last legs. I only pray that it lasts for several month. However I will probably soon need a newer more reliable car and I don’t have any money in savings for a down payment. After I finish paying the lawyer, they will file and I can save the money I am paying them to put towards a used car, but will not have enough to totally pay for it.
Look, this is not something that I WANT to do, I have not choice. And FYI this all started with a job loss. I have been struggling, trying to do everything I could NOT to file but it’s gotten so big there is no other way. Don’t judge me – you don’t know my circumstances. I’m not someone who just goes out and buys things I can’t afford just for the heck of it and then expects someone else to pay. I’m a single gal who got a bad break and is in over her head!

how do I remove items that were supposed to be removed from my credit report due to bankruptcy?

m asked:

I had a few judgements that were supposed to be removed from my credit report when I filed for chapter 7 bankruptcy, but 2 of them are still on there. How do I get these removed, like who do I contact. One I had contacted someone before and they said they were going to remove the item, yet they haven’t and it is being reported on all 3 agencies which I am sure is bringing my score down. The other one is only on my experian, but it should have been removed once I declared bankrupcy right. There was also a collection that was never removed. All three of these items are on my discharge report and my report when I filed, so they should be gone right. Any info would be greatly appreciated.
